Why Text Messages Win Lawsuits | The Evidence Series:  Part 2

In Part 1 of The Evidence Series, we discussed how you're creating evidence every day, often without realizing it.

This week, we're focusing on one of the most powerful forms of evidence in modern litigation:

Text messages.

Most business owners think of text messages as a quick, convenient way to keep a project moving. But if a dispute ends up in court, those same messages can become some of the most persuasive evidence in the case.

Why?

Because text messages are often written in the moment. They capture what someone was thinking, what they knew, and how they responded before anyone expected a lawsuit.

We've seen cases where a single text message clarified a misunderstanding, confirmed a change in scope, or demonstrated that a contractor acted reasonably throughout the project.

We've also seen text messages create unnecessary problems.

A rushed response.

An emotional reaction.

An offhand comment intended to keep the peace.

Or a promise made without considering its legal implications.

Standing alone, those messages may not seem significant. But when read alongside emails, photographs, contracts, and project records, they become part of the story a judge, jury, or opposing attorney is trying to piece together.

That doesn't mean you should stop texting your customers.

It means you should text with the understanding that one day, someone other than the homeowner may be reading those messages.

Before you text a client about a delay, a quote, or a change order, remember three words:  

Professional. Clear. Accurate.

In the pool construction industry, a single misunderstood text can lead to a costly mistake. Creating a company policy to incorporate these standards into every text message protects both your projects and your profits.
