Fraud and Misrepresentation Scenarios

  • A jeweler sells Matt a 2 carat diamond engagement ring that is later found out to be a 1 carat cubic zirconia. At the time of the purchase, the jeweler knew that the ring was not a real 2 carat diamond ring. This scenario is an example of fraud because the jeweler intentionally sold a ring he knew to be fake as the real thing.

  • Amy is purchasing a new business from John that includes a warehouse. John told Amy that the warehouse was 10,000 square feet. Amy later learns that the warehouse is actually 7,500 square feet. John, however, did not have knowledge of the square footage of the warehouse at the time of the transaction. This is an example of misrepresentation.
