What is a Pedestrian Accident?

The Florida Department of Highway Safety and Motor Vehicles (FLHSMV) defines a pedestrian accident as that which involves an individual who was not occupying a motor vehicle, bicycle, or mobile conveyance.  In 2020, there were 483 pedestrian crashes in Palm Beach County of which, 44 pedestrian crashes that resulted in a fatality, according to FLHSMV.

Some causes of pedestrian accidents are:

  • Distracted driving

  • Speeding

  • Drunk driving

  • Impaired driving

  • Texting while driving

  • Bad lighting

Florida Pedestrian Law Key Points:

According to the Florida Statute §316.130 (2020) pedestrians must:

  • use sidewalks and crosswalks when provided.

  • walk on the left side of the road facing traffic, which will approach from the opposite direction when sidewalks are not provided.

  • not leave a curb or safe area to walk in the path of a car, making it impossible for a driver to yield.

  • obey the traffic control signals at intersections unless otherwise directed by a police officer.

Pedestrians have the right-of-way in a crosswalk with a walk signal or when traffic control signals are not in place or operating correctly and there is no signage indicating otherwise.

Common injuries associated with a pedestrian accident include:

  • Brain injuries

  • Broken bones

  • Lost wages and loss of earning capacity

  • Pain and suffering

  • Mental anguish

  • Disability
